INTRODUCTION

These Terms & Conditions govern The Great Getaway x Birch Stays x ourlittlebrickcottage giveaway promotion (the “Promotion”) and outline the legal responsibilities and obligations between you and Birch Stays (also referred hereafter as “Birch Stays”, “we”, “us”, “our”).

By entering this Promotion, you confirm that you have read, understood and agreed to these Terms & Conditions, together with our Privacy Policy.

COPYRIGHT & TRADEMARK

All content featured on Birch Stays platforms, including but not limited to images, photography, logos, branding, designs, written copy and other materials, is owned by or licensed to Birch Stays and protected by copyright, trademark and other intellectual property laws. No material may be copied, reproduced, distributed or used without prior written permission from Birch Stays.

PROMOTER

ourlittlebrickcottage is the lead promoter of this giveaway. Birch Stays is responsible for the administration of the Promotion and fulfilment of the prize.

  1. Eligibility
    1. The Promotion is open to residents of the United Kingdom aged 18 years or over.
    2. Employees, directors, agents, contractors and immediate family members of Birch Stays, ourlittlebrickcottage, The Great Getaway, or any associated partner brands are not eligible to enter.
  3. How to Enter
    1. Entry is free and no purchase is necessary. Multiple entries are permitted unless otherwise stated on the relevant Instagram post.
    2. Instructions on how to enter, including the opening and closing dates and times, will be clearly stated on the relevant Instagram post.
    3. Entries that do not comply with the entry instructions, or that are submitted outside of the stated entry period, will be deemed invalid.
    4. Birch Stays reserves the right to disqualify any entries that are incomplete, fraudulent, generated by automated means, or otherwise breach Instagram’s Community Guidelines.
  5. Prize
    1. The prize consists of a two-night stay at The Carriage House. https://birchstays.com/property/the-carriage-house/
    2. The prize is valid for midweek stays only (Monday–Friday) during off-peak periods, excluding school holidays and UK bank holidays. All stays are subject to availability and Birch Stays booking terms and conditions.
    3. The stay must have occurred by the 30th September 2027. Bookings must be arranged directly with the Birch Stays team via email or Instagram direct message. If the stay has not happened by this date, the prize will expire and no alternative prize will be offered.
    4. The prize is non-transferable, non-refundable and cannot be exchanged for cash or any alternative prize. Travel, transportation and additional expenses are not included.
    5. The winner will be required to pay a refundable security deposit at the time of booking. This deposit is intended to cover any loss or damage caused during the stay. The security deposit amount is £200, and will be refunded within 5 days of departure, subject to a satisfactory property inspection, with the option to pay with the damage waiver instead.
    6. If the advertised prize becomes unavailable due to circumstances beyond The Great Getaway, Birch Stays’ or ourlittlebrickcottage reasonable control, Birch Stays reserves the right to substitute the prize with an alternative of equal or greater value.
    7. Maximum of six guests and one dog.
    8. The prize is subject to availability and must be booked in advance.
    9. No cash alternative is available
  7. Winner Selection & Notification
    1. The winner will be chosen at random using a computer-generated process.
    2. The winner will be contacted via direct message from the official @birchstays Instagram account only.
    3. The winner must respond within 7 days of being contacted. If no response is received within this timeframe, Birch Stays reserves the right to select an alternative winner.
    4. Birch Stays and The Great Getaway reserves the right to request reasonable proof of identity, age and UK residency from the winner. Failure to provide satisfactory documentation may result in disqualification.
  9. Publicity & Use of Personal Data
    1. Birch Stays may announce the winner’s first name and/or Instagram handle on its social media channels.
    2. Any further marketing use of a winner's image, likeness or content will require the winner's separate explicit consent.
    3. Any personal data supplied during the Promotion will be processed in accordance with applicable data protection laws and Birch Stays’ Privacy Policy.
  11. Limitation of Liability
    1. Except where prohibited by law, The Great Getaway, Birch Stays and littlebrickcottage shall not be liable for:
    • lost, delayed, incomplete or misdirected entries;
    • technical malfunctions or failures relating to Instagram or digital systems;
    • any loss, damage or injury arising from participation in the Promotion or use of the prize.
    1. Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be excluded.
    2. Your statutory rights are not affected.
  15. General
    1. The Great Getaway and Birch Stays reserves the right to suspend, cancel or amend the Promotion where necessary due to circumstances beyond its reasonable control.
    2. These Terms & Conditions form part of the entry requirements for the Promotion.
    3. The Promotion and these Terms & Conditions are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.

This Promotion is in no way sponsored, endorsed, administered by, or associated with Instagram. By entering, participants acknowledge that Instagram bears no responsibility or liability for this Promotion.
